Chaperone and Student Behavior
Expectations and Policies
For almost 60
years, Grad Nite at the Disneyland® Resort has
been a rite of passage for millions of graduating seniors. Disney’s
goal is to create a safe environment that is enjoyable for everyone,
including all of Disney’s Guests and Cast. Disney has made several
updates to the Grad Nite behavior expectation Guidelines and Terms
& Conditions, and Disney will be strictly enforcing these
updated guidelines. With School’s help, Disney can carry on the legacy
of Grad Nite at the Disneyland® Resort as the
magical and memorable experience that it is today.
Disneyland® Resort
Grad Nite Policies
- It is School’s
responsibility to ensure that all students and chaperones attending the
Grad Nite event arrive at the Disneyland® Resort
sober and without drugs or alcohol in their possession. Disney expects
Schools to conduct thorough bag checks and student screenings before allowing students to
board buses for the Grad Nite event. However, chaperones and students
will be reminded of Disney’s Guidelines and Terms & Conditions when
they get off the buses at the Disneyland® Resort.
- In association
with the Anaheim Police Department, Disney will be conducting searches
for banned substances that will include bag searches and the use of
drug-sniffing canines. If bag searches and/or the drug-sniffing canines
indicate the presence of an illegal substance, Disney will ask the
subject chaperone or student for permission to conduct a pat down
search.
• If any banned
substances are found on the bus or on a Grad Nite participant or
chaperone, the matter will be turned over to the Anaheim Police
Department. Additionally, if School violates this policy, School will
be subject to be uninvited to attend future Grad Nite events.
- Chaperones are
expected to provide adult supervision and therefore are NOT
permitted to drink alcohol while at the Disneyland® Resort the
day of the Grad Nite event. Chaperones violating this policy
will not be allowed into the Grad Nite event and may jeopardize future
Grad Nite invitations for School.
- While Disney
wants every graduating senior attending the Grad Nite event to enjoy
the celebration, Disney also expects those attending the Grad Nite
event to respect other day Guests and Grad Nite Guests with whom they
will be sharing the Park. Certain celebratory behavior can be extremely
intimidating to other Guests — especially families with small children
— and therefore, should only be displayed after the private the Grad
Nite event kicks off. The
following behaviors are prohibited at the Disneyland® Resort
and/or the Grad Nite event:
• Groups walking
and/or running in locked arms (this can appear threatening to other
Guests and is a safety concern in impacted areas).
• Groups
chanting of any kind (this can be disruptive to other Guests).
• Yelling at
high volumes in attraction queues.
The following behavior is not tolerated at all at
the Disneyland® Resort:
- Inappropriate
touching or physical aggression of any kind
- Failure to
comply with a request of a Disney Cast Member (Disney Cast Members are
trained to direct Disney’s Guests for optimal safety and to comply with
Disney’s standards of conduct)
- Inappropriate
language
- Theft or
vandalism
- Line jumping
in attraction queues
- Failure to
comply with attraction guidelines
The following
items are prohibited from being brought into or used inside the Park:
· Alcoholic
beverages or any illegal substance
· Glass
containers
· Outside food
or liquids
· Weapons of any
kind, or objects that appear to be weapons
· Laser pointers
or other items deemed potentially harmful or disruptive
· Smoking,
vaping and electronic cigarettes
If a Chaperone
sees any inappropriate behavior, Disney asks that the Chaperone
immediately notify a Disney Cast Member. And if a student or Chaperone
is expelled from the Disneyland® Resort or from
the Grad Nite event, it is the responsibility of School to remove the
student or Chaperone from Disney property. For additional information

By
acknowledging where indicated below, School consents that School has
read these Guidelines and Terms & Conditions and that School will
communicate these Guidelines and Terms & Conditions to both
Chaperones and student participants. School also agrees to ensure that
School’s Chaperones help enforce these Guidelines and Terms &
Conditions while attending the Grad Nite event with School. School will
not be allowed to purchase tickets without acknowledgment of these
Guidelines and Terms & Conditions.
School, by
acknowledging where indicated below, shall acquire no right to
use, and shall not use, the names “Disneyland” or “Disney” (either
alone or in conjunction with or as a part of any other word or name) or
any fanciful characters or designs or other intellectual property of
Disney or any of its affiliates: (i) in any advertising,
publicity or promotion; (ii) to express or to imply any endorsement by
Disney or its affiliates of School or School’s services; (iii) in any
other manner or for any purpose whatsoever (whether or not similar to
the uses prohibited by (i) and (ii) above), except as provided in these
Guidelines and Terms & Conditions.
School shall
not offer to sell nor sell any Grad Nite Tickets or Wristbands to any
persons other than Grad Nite participants and School shall sell the
Grad Nite Tickets and Wristbands only in connection with the Grad Nite
event. School shall not sell or transfer any Grad Nite Tickets or
Wristbands to any travel wholesaler, tour operator or other person or
entity that intends to resell and/or retransfer the Grad Nite Tickets
or Wristbands and/or is otherwise not a Grad Nite participant and the
end user of the Grad Nite Tickets and Wristbands. School shall
not offer to sell nor sell any Grad Nite Tickets or Wristbands on
the Disneyland® Resort (the “Resort”)
premises.
Rules and
Regulations. The
Grad Nite event shall be governed by and conducted in accordance with
such rules and regulations Disney may establish, in Disney’s sole and
absolute discretion, for the Grad Nite event (including, without
limitation, the hours of operation of the Grad Nite event, the rules
set forth on the Grad Nite Tickets and Wristbands, rules regarding no
smoking, dress/attire standards (refer to the Chaperone Planning Guide
or website for most updated guidelines, rules requiring the Grad Nite
event participants to remain in the park until 2:00
a.m., and all applicable laws, rules, regulations and
ordinances of any and all governmental authorities having
jurisdiction). Disney suggests that at least one (1) Chaperone
from School make their way back to their bus at that time to be there
for School’s Grad Nite event participants, in the event that School
decides to leave the Park and go to the bus at that time.
Disney
reserves the right to refuse admittance to any person within School’s
group who does not comply with any of the foregoing (or, after
admittance, to deprive them of the use of the facilities by delivering
them into the custody of any of School’s Chaperones) without any
liability to such person or School. Disney reserves the right to
remove a Grand Nite event participant or Chaperone or other person
within School’s group from the Grad Nite event after notification to
School of a violation of any applicable rules and/or guidelines by any
Grad Nite event participants and/or any employees, agents,
representatives and/or Chaperones of School.
Indemnification: By
acknowledging where indicated below, School agrees to defend (if
requested by Disney and with counsel selected by Disney), indemnify and
hold Disney, its parent, subsidiary, related and affiliated companies
and the officers, directors, agents, employees and assigns of each,
harmless from and against any and all claims, suits, damages,
liabilities, costs and expenses (whether based on tort, breach of
contract, patent and/or copyright infringement, product liability
and/or otherwise), including, without limitation, attorneys' fees and
costs (collectively, “Losses”), arising in any way from and/or out of
and/or based on School’s offer to sell and sale of the Grad Nite
Tickets and/or Meal Vouchers and/or any Disney gift cards; the falsity
of any warranties set out herein; any act and/or omission of School,
its officers, directors, agents, employees, any of School’s groups
and/or any of the Grad Nite event participants and/or the Chaperones of
such groups; and/or any breach or alleged breach of any of School’s
representations, warranties, obligations and/or agreements hereunder.
The provisions of this paragraph shall survive, indefinitely, any
expiration or early termination of any agreement between School and
Disney for the Grad Nite event and shall not be limited by the amount
of insurance maintained by School.
Before a
Ticket Order can be fulfilled for School, one hundred percent (100%)
pre-payment is due forty-five days prior to the Grad Nite event date to
guarantee School’s order for all Grad Nite Tickets and Wristbands and
Chaperone Tickets (as defined below). All payments must be made by
either a School check, credit card or cashier’s check drawn on a U.S.
bank payable to “Disney Destinations, LLC”.
Termination. Disney shall
have the right to immediately cancel the Grad Nite event in Disney’s
sole and absolute discretion and for any or no reason whatsoever upon
notice to School. In such case, Disney shall reimburse School for
any monies paid by School to Disney for Grad Nite Tickets and Chaperone
Tickets to the cancelled Grad Nite event, and School shall be
responsible for reimbursing each purchaser for such Grad Nite Tickets
and Chaperone Tickets (that have been paid for and were not
complimentary). Disney’s obligation to reimburse School, as foresaid,
shall be Disney’s sole obligation as a result of such cancellation, and
Disney shall not be liable for damages to School, or to anyone claiming
by, through or under School, as a result of such cancellation.
Upon such cancellation, School shall return to Disney all Grad Nite
Tickets and Wristbands and Chaperone Tickets previously issued by
Disney to School for the Grad Nite event. Without liability, any
cancellation of any entertainment scheduled to appear at the Grad Nite
event shall not constitute a breach of any agreement, nor shall School
or the Grad Nite event participants be entitled to a refund of, or
reduction in, the amount charged for the Grad Nite Tickets due to such
cancellation of entertainment. School hereby irrevocably waives
any right to injunctive relief and/or right of recession and hereby
agrees that School’s sole and exclusive remedy in the event of any
breach and/or alleged breach, termination, and/or cancellation of any
agreement between School and Disney by Disney shall be an action for
monetary damages. Upon any cancellation of the Grad Nite event,
Disney may exercise any or all of its rights and remedies at law and/or
in equity.
Videotaping/Filming.
(i)
School understands and agrees that School may photograph, videotape,
audio-record or film Disney musicians, performers, or show elements at
the Grad Nite event provided however, that any such photographs,
videotape, audio-recordings and/or film may only be portions of a
performance and not the entire performance, and shall be limited to
internal, archival, and/or non-commercial personal purposes only (and
cannot, for example, be uploaded to Facebook, YouTube or the like via
cell phone or in any other manner). School further understands
and agrees that School’s camera crew, if any, may be escorted at all
times by a Disneyland® Resort Marketing
Representative.
(ii)
If notwithstanding the foregoing, School does use, or it is determined
that School has used, any such photographs, videotape, audio-recordings
and/or film that contain images and/or voices of Disney musicians,
performers or show elements for any commercial purpose, and School is
not a party to a collective bargaining agreement with the American
Federation of Musicians, then School agrees to sign, upon
presentation by the American Federation of Musicians, a onetime
applicable American Federation of Musicians Agreement and fulfill all
conditions required by the applicable agreement pertaining to such use
of this product, including, but not limited to, payment of all
applicable wages and benefits that School would be obligated to pay to
the American Federation of Musicians for such usage had School been a
party to a collective bargaining agreement with the American Federation
of Musicians. The provisions of this paragraph shall survive the
expiration or earlier termination of any agreement between School and
Disney for the Grad Nite event.
(iii) School
acknowledges that it has been advised of the terms and conditions
regarding any photographing, videotaping, audio recording or filming of
Disney musicians, performers, or show elements during the Grad Nite
event.
**All parks,
attractions, entertainment, tickets and other items described on this
Ticket Store (and in any collateral sent by Disney to School in
connection with the Grad Nite event) and all prices, operating hours,
age requirements, and other terms for such items may be changed or
discontinued without notice and without liability. The owners of
the Disneyland Resort reserve the right to refuse admittance to any
persons, and shall not be liable for non-utilization of Grad Nite
Tickets or loss of recreational opportunities due to refurbishing,
capacity, inclement weather, special events or any circumstance beyond
the owners’ control. Entertainment is subject to change without notice.
